The registered company LEJA REWARDS PTY LTD (ACN: 700 969 124) trading as LEJA (LEJA, us, we, our) values the privacy of its customers. This Privacy Policy describes LEJA’s practices with regards to information we collect through our own controlled websites and applications.

This Privacy Policy has been developed in accordance with the Privacy Act 1988 (Cth) (Act).

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third party, including social media platforms and other websites either containing links to LEJA’s controlled websites and applications or that are linked from LEJA’s controlled websites and applications.

By using the goods and services, website and/or application of LEJA, you accept the terms of this Privacy Policy and consent to our collection, use and disclosure of your personal information in accordance with this Privacy Policy.

Terms capitalised and not defined in this Privacy Policy have the meaning in our Terms and Conditions.

You are not required to provide personal information to us. However, if you do not provide us with requested personal information, we may not be able to provide you with our services or enter you into our promotions.

Information We Collect

LEJA collects information about you, where you are identified or reasonably identifiable, as personal information.

Information collected by LEJA may include the following:

Full name;
Date of birth;
State of residency;
Postal address;
Telephone number;
Email address; and
Bank account details.

LEJA may also collect and/or retain information obtained through your use of the LEJA Platform and subscription service, including:

Account credentials and login activity;
Subscription tier and billing history;
Promotion entry history, team selection, and competition results;
Referral activity; and
Any other information voluntarily provided when contacting LEJA directly or through use of the LEJA Platform or subscription service.

LEJA also collects information about you where are not identified or reasonably identifiable. This information is not personal information.

How We Collect Personal Information

Ways in which personal information may be collected include, but are not limited to, collection through our controlled websites and applications; by email; and offline, such as over a phone call.

If you use your social media or third-party account to enter our promotions, or via an invitation to sign into such account on our controlled websites, personal information in connection with those accounts may be collected, including your name, email address, social media contacts and other personal information.

Use of Personal Information

LEJA and its third-party associates may use personal information collected for the purposes for which it was collected, and in connection with those purposes.

LEJA may also use your personal information in ways that you have consented to, and will always endeavour to be clear as to why your information is being collected, and how it will be used.

Purposes for which personal information may be used by LEJA include:

To create and manage your subscriber account
To process and manage your subscription payments via the nominated third party processor (eg Stripe);
To provide you with access to the Platform and subscription benefits;
To allocate and manage Promotion entries;
To verify your eligibility to participate in and win Promotions, including age and state of residency verification
To process and pay out Promotion prizes;
To operate and manage the referral program;
To communicate with you regarding your subscription, competition results, platform updates, and promotional activities;
To display your participation in the community chat features;
To comply with applicable legal and regulatory obligations;
To detect and prevent fraud, manipulation of the competition, or misuse of the platform;
To improve our platform, services, and user experience;
To respond to your enquiries and support requests
To provide marketing and advertising communications from us that may be of interest to you.

You have the option to opt-out of marketing communications provided by us. To opt out of marketing communications, please use the unsubscribe function contained in our marketing emails or email us at contact@leja.com.au to advise us of this preference. In any email correspondence, please clearly specify which communications you wish to opt out of.

LEJA does not sell personal information to third parties such as advertising networks or data brokers.

Personal information may be anonymised to generate data for our use, such as data about membership numbers and location. Where data is anonymised, it will no longer be considered personal information, and can be disclosed for any purpose.

Disclosure of Personal Information

LEJA conducts a number of Promotions where entrants can win prizes. The names of prize winners will be published on our website and/or application as required by law, and may be used for marketing or promotional purposes.

The personal information of entrants to promotions may also be disclosed to State and Territory regulators in accordance with relevant legislation.

Personal information may be disclosed in connection with any sale, assignment, transfer or any other disposition of all or any portion of the business, company or stock.

Personal information may be disclosed to third-party partners or service providers in connection with your use of our services, and to facilitate services provided to LEJA, including data analysis, payment processing, technology and hosting providers, and other services.

Personal information may be disclosed where required by any applicable law, requests from government or law enforcement authorities or for any other legal reason.

Payment information

LEJA subscription payments are processed by Stripe, a third party payment processor.

LEJA does not collect, store, or have access to payment card details provided through Stripe.

By making a payment through the LEJA platform, you acknowledge that you are also subject to the Stripe’s Privacy Policy and Terms of Service.

LEJA retains a record of your subscription and billing history for account management and legal compliance purposes. This does not include full payment card numbers or CVV codes.

Retention Period

LEJA will retain your personal information for such time period as is required or permitted, considering the purposes for which it was obtained and the requirements under any applicable law.

Subscription and billing records are retained for a minimum of seven (7) years, in line with Australian taxation and financial record-keeping requirements.

Competition entry records, including team selections and prize payment records, may be retained for the period required under applicable trade promotion legislation.

Where you request deletion of your account and personal information, we will comply in accordance with the relevant provisions of this Policy, subject to any legal retention obligations.

Sensitive Personal Information

LEJA does not propose to collect any sensitive personal information, which includes information relating to your race or ethnicity, political opinions, health status and other sensitive personal information.

If such information is collected, it will be dealt with as required by any applicable law.

Information Other Than Personal Information

LEJA may collect information that is not personal information. This includes information such as browser and device information, information collected through cookies, geographic location information and other information that does not personally identify you.

This information may be collected in a number of ways, including through use of cookies and other similar technology and through your Internet Protocol (IP) address. This information may also be collected by anonymising your personal information so that it does not personally identify you, such as through an aggregated data set regarding our membership base.

This information will not personally identify you.

We may disclose information that is not personal information for any purpose provided this is in accordance with applicable law.

Cookies

The LEJA website and platform may use cookies and similar tracking technologies to enhance your browsing experience, track platform usage, and improve our services.

Cookies are small files stored on your device that help us recognise you when you return to the platform and remember your preferences.

You may manage or disable cookies through your browser settings. Please note that disabling cookies may affect the functionality of certain parts of the LEJA platform.

LEJA does not use cookies to track your activity across third-party websites for advertising purposes.

Security

All personal information collected by LEJA is stored on Australian-based servers. No personal data is stored or processed outside of Australia.

LEJA will take reasonable measures to protect personal information supplied to us through our controlled websites against misuse, interference and loss, and from unauthorised access, modification or disclosure, including:

encryption and secure servers;
only accessing personal information on a need-to-know basis and by authorised personnel;
monitoring system access which can only be accessed by authenticated credentials;
regularly updating and auditing our storage and data security systems.

While we take reasonable precautions, no method of data transmission or storage is completely secure. LEJA does not guarantee the absolute security of information transmitted to or stored via the Platform or subscription service.

In the event of a data breach that is likely to result in serious harm to any individual whose information is involved, LEJA will comply with its obligations under the Notifiable Data Breaches scheme, including notifying affected individuals and the Office of the Australian Information Commissioner (OAIC) as required.

You also have an important role in keeping your data secure. You agree that are responsible for maintaining the confidentiality of your account details and password, and for any activities that occur in your account, or in respect of your use of LEJA’s applications and services.

If you believe that there has been suspicious activity on your account or that your interactions with us are no longer secure, please notify us immediately at contact@leja.com.au.

Accessing, Changing or Deleting Personal Information

Under the Australian Privacy Act 1988 (Cth), you have the right to:

Request access to the personal information LEJA holds about you
Request correction of any personal information that is inaccurate, out of date, incomplete, irrelevant, or misleading; and
Make a complaint about how LEJA has handled your personal information

To access, review, correct, update or delete personal information that has previously been supplied to LEJA, you can:

submit the relevant request via your account settings on the LEJA Platform; or
email us at contact@leja.com.au clearly indicating the purpose of the request in the subject line, and including your full name and email address in the body of the message.

You may also contact us by email to object to our use of previously supplied personal information or to request an electronic copy of information supplied to us.

We will respond to all requests in accordance with applicable law, and will take commercially reasonably steps to do so within 30 days of the receipt of the request.

In some instances, we may be required to retain your personal information in order to comply with applicable laws, including in relation to record keeping requirements. In such instances we will retain your personal information in accordance with any applicable law.

Where your account is deleted, you will lose access to the LEJA platform, all subscription benefits, and any unused giveaway entries. No refund is payable in respect of any remaining subscription period unless required by Australian Consumer Law.

Marketing Communications

By creating a LEJA account, you consent to receiving communications from us relating to your subscription, weekly competition results, platform updates, and promotional activities.

You may opt out of marketing communications at any time by:

Clicking the unsubscribe link in any marketing email; or
Contacting us directly at contact@leja.com.au.

Opting out of marketing communications will not affect transactional communications relating to your subscription, payment processing, competition results, or prize notifications. These are necessary for the operation of your account and cannot be opted out of while your subscription remains active.

Third-Party Links And Partners

The LEJA platform may contain links to third-party websites, including discount dashboard partners, and other external services. LEJA is not responsible for the privacy practices of those third-party websites.

We encourage you to review the privacy policies of any third-party websites you visit through links on the LEJA platform.

Where you interact with third-party partner offers through the LEJA discount dashboard, that partner may collect personal information about you directly. Such collection is governed by the partner's own privacy policy and is outside LEJA's control.

Privacy of minors

The LEJA Platform is intended for users aged 18 years and over.

LEJA does not knowingly collect personal information from individuals under the age of 18. If you believe a person under 18 has provided us with their personal information without appropriate consent, please contact us immediately at contact@leja.com.au and we will take steps to remove that information.

Updates to Privacy Policy

LEJA may change this Privacy Policy at any time. Any changes to this Privacy Policy will be effective from the time that the revised Privacy Policy is made available via our controlled websites, applications or other platforms.

Where changes are material, we will endeavour to notify active subscribers by email or through the Platform before the changes take effect.

Your continued use of the LEJA Platform after updated Terms are published, constitutes acceptance of the updated Privacy Policy.

Governing Law

This Privacy Policy is governed by and must be construed in accordance with the laws of Victoria, Australia.
