Terms and conditions

1. Acceptance of Terms

• (a)These terms and conditions (Terms and Conditions), as amended from time to time, govern the provision and/or use of any goods and/or services provided by the registered company LEJA REWARDS PTY LTD (ACN: 700 969 124) trading as LEJA (LEJA, us, we, our), including any website or digital services or analytics content, as well as subscription services, and any promotions (Promotion, Promotions) conducted in connection with that content.
• (b)Any use of the website, application or analytics platform of LEJA, and any registration of a membership or purchase or use of other goods and services of LEJA, constitutes an agreement to and acceptance of these terms and conditions, including as amended.
• (a)These Terms and Conditions are to be read, where appropriate, in conjunction with the Promotion Details listed for each Promotion, which set out details relating to the specific conduct of that Promotion.
• (c)Amendments to the Terms and Conditions may result in changes to the content or Promotions that they pertain to. Amendments are effective when they are updated on the website and/or application, and any subscribers of LEJA or users of the website, application, goods, or services agree to and are bound by those changes.

2. Privacy

• (a)LEJA is bound by and obtains, uses and disseminates information in accordance with the Privacy Act 1988 (Cth).
• (b)LEJA’s privacy policy (Privacy Policy), as amended from time to time, is published on its website and/or application.
• (c)By agreeing to these Terms and Conditions, you also agree to your information being collected, used and disseminated in accordance with the Privacy Policy, including as amended.

3. Goods and Services

Platform and subscription service

• (b)LEJA is a sports analytics and fantasy competition platform that offers subscribers access to proprietary sports analytics, player projections, confidence scores, matchup data, and related content across multiple sports (the Platform).
• (c)LEJA may offer different tiers of membership which have different levels of access to the Platform, rewards, discounts, benefits and fees associated with them. Details regarding the access to the Platform, rewards, discounts, benefits and fees for each tier are available via the LEJA website and/or application, and may be amended by LEJA at its discretion.
• (d)Notice of subscription fee changes may be provided where required by law. Continued use of the Platform, Promotions and associated goods and services following notification of a fee change constitutes acceptance of the amended fee.
• (e)The Platform, subscription program and its associated goods and services are open only to people who are residents of Australia and are 18 years of age or older.
• (f)LEJA reserves the right to verify the identity, age, state of residency and eligibility of any subscriber at any time.
• (g)LEJA reserves the right to:
  • (i)add, remove, vary, substitute or discontinue any or all goods and services; and
  • (ii)refuse, suspend or vary membership to the Platform;
  in its sole discretion at any time.
• (h)LEJA does not guarantee uninterrupted, error-free or continuous access to the Platform. Scheduled maintenance, technical issues, or third-party service outages may impact availability.
• (i)The conduct of Promotions conducted by LEJA will be in accordance with these Terms and Conditions, as well as any additional requirements which may be stipulated for that Promotion from time to time.
• (j)By subscribing to LEJA, you accept these Terms and Conditions, and warrant that you meet the eligibility criteria of the Platform and of the Promotions.

Discount Dashboard And Partner Offers

• (k)All active subscribers receive access to a discount dashboard featuring offers and deals from third-party brands and partners. The scope and value of discounts varies with each subscription tier.
• (l)Discount dashboard offers are supplied by independent third-party partners. LEJA does not control partner businesses and is not responsible for the availability, accuracy, or continuity of any offer.
• (m)Any rewards and discounts offered by third-party partners and available via LEJA as part of subscribers’ use of the Platform may be subject to additional terms and conditions, limitations or eligibility criteria set by those third parties. LEJA makes no warranty or representation in respect of any such terms and conditions.
• (n)Partner offers may be amended, suspended or withdrawn at any time without notice.
• (o)Queries, concerns or disputes regarding third-party partner offers or products should be directed to the relevant provider.

Community Chat

• (p)LEJA provides tiered community chat features to subscribers, with the level of access scaled by subscription tier.
• (q)By using the community chat service, you agree, represent and warrant that you will behave respectfully and lawfully, and will not:
  • (i)Harass, threaten, abuse, or discriminate against other members;
  • (ii)Post false, misleading, or defamatory content;
  • (iii)Share content that promotes wagering, gambling, or betting;
  • (iv)Engage in fraudulent or unlawful activity; or
  • (v)Post spam, unsolicited advertising, or promotional content without LEJA’s approval.
• (r)LEJA reserves the right to remove content and suspend or terminate access to community features, the Platform, or membership overall for any member who breaches these conduct standards at its absolute discretion.

2. Terms of use

• (a)As part of any registration for membership of LEJA, you may be asked to provide information (User Information) including your email address, phone number and other personal information, payment card number, username (which LEJA may refuse to accept at its sole discretion) and password.
• (b)You agree, represent and warrant that:
  • (i)any information you provide to LEJA in connection with membership, the Platform or the use of any goods and services (including User Information) is true and complete (both at the time of registration and on an ongoing basis);
  • (ii)you are the individual identified in any application, subscription or registration or verification process, and you do not or will not authorise another person to complete any such information on your behalf;
  • (iii)you are an authorised user of any registered payment card used or proposed to be used in connection with LEJA;
  • (iv)any failure to provide or maintain true and complete information is a breach of these Terms and Conditions; and
  • (v)you will immediately update your User Information with LEJA in the event of any change in your circumstances which would render the User Information incomplete or inaccurate.
• (c)If you provide or fail to update any User Information or where LEJA believes any User Information to be untrue, inaccurate, not current or incomplete, LEJA may suspend or terminate your LEJA account and remove, suspend or vary your access to the Platform, and any associated rewards or Promotions, without notice.
• (d)All memberships and rights and property associated with the memberships are personal and may not be shared or transferred.
• (e)You agree to notify LEJA immediately of any known or suspected unauthorised access of your account or breach of security or your password.
• (f)LEJA is not responsible for any loss or damage where you have not maintained the confidentiality of your account.
• (g)LEJA reserves the right to take any reasonable steps, including restricting, limiting or terminating any membership, in the event of:
  • (i)a breach or suspected breach of these Terms and Conditions;
  • (ii)suspected fraud or manipulation of Promotions; or
  • (iii)misconduct in the use of community features.
• (h)By purchasing a recurring subscription, you authorise LEJA and its payment processor to automatically process future subscription fee payments using your nominated payment method at the conclusion of each billing cycle.
• (i)Subscriptions will automatically renew at the conclusion of each billing cycle unless cancelled by the subscriber prior to the next renewal date.
• (j)In the event of a failed subscription fee payment, LEJA reserves the right to either:
  • (i)Retry payment processing;
  • (ii)Suspend subscription benefits and Promotion entry allocation;
  • (iii)Restrict account access; or
  • (iv)Cancel the subscription, following reasonable attempts to contact the subscriber and process payment.
• (k)LEJA may otherwise suspend, cancel or refuse payment in the event of any suspicion of fraud or unlawful behaviour at its discretion.
• (l)Purchases of goods and services, including subscriptions/memberships, are non-refundable except where required by law.
• (m)You agree that in using any goods or services of LEJA (including the Platform and Promotions, and associated website and/or application) you will not:
  • (i)violate any applicable law or regulation, including any infringement of copyright, trademarks or improperly use, obtain or disclose confidential or private information;
  • (ii)participate in any defamatory, harmful, or inappropriate conduct towards any person;
  • (iii)impersonate another person or entity;
  • (iv)participate or be knowingly involved in, directly or indirectly with, any breach or attempted breach of any security of the confidential or private information held by LEJA, including any account holders’ information or software data; or
  • (v)upload malicious code or software, or otherwise attempt to compromise the security or integrity of the Platform
• (n)LEJA reserves the right to recover losses, costs, and damages arising from fraudulent activity or misuse of the Platform.
• (o)All communications, comments and submissions with LEJA in connection with any use of the website and/or application or any goods or services are the exclusive property of LEJA. In making any communication, comment or submission to LEJA you agree that the contents therein are assigned to LEJA to deal with in its absolute discretion.
• (p)All users are solely responsible for any violation of the Terms and Conditions and of any relevant laws or third-party rights as a result of their conduct, and you indemnify LEJA for any loss or damage suffered in connection with any violation.
• (q)Any and all services, content, information and products belonging to third-party providers that may be available, advertised or featured on the LEJA website or application, or in any communications, are made without any representation or warranty by LEJA regarding those products or services.

3. Intellectual Property

• (a)All content, analytics, projections, models, branding, graphics, software, and intellectual property made available through the LEJA Platform remain the exclusive property of LEJA and its founders.
• (b)Subscribers receive a limited, personal, non-transferable licence to access and use Platform content for their own personal, non-commercial use only.
• (c)Content may not be copied, reproduced, distributed, published, or commercially exploited without LEJA’s prior written consent.
• (d)LEJA’s analytics models, projection methodologies, and scoring systems are proprietary. Any reproduction or reverse engineering of these systems is strictly prohibited.

4. Termination of membership

• (a)You may cancel any membership or subscription at any time by giving notice in writing to LEJA support, or via any designated mechanism in the website and/or application, with such cancellation to take effect on the later of:
  • (i)receipt by LEJA; and
  • (ii)the end of the membership period for which fees have been paid,
  unless you request the cancellation to take place immediately.
• (b)Cancellation of your membership will not release you from any fees or obligations owed to LEJA in respect of your membership.
• (c)Following the date upon which termination or cancellation of your membership comes into effect, you will no longer be eligible to:
  • (i)Access the Platform, rewards or discounts for which membership is required;
  • (ii)Be entered into any Promotions;
  • (iii)Remain entered in any Promotions; or
  • (iv)Collect any rewards or prizes won in Promotions which have closed prior to cancellation of your membership but for which prizes have not yet been distributed.

5. Consumer rights & obligations

• (a)The Australian Consumer Law (ACL) requires businesses to provide consumer guarantees for goods and services that apply regardless of any warranty, and cannot be excluded.
• (b)For any minor problem with goods or services provided, LEJA may choose at its discretion whether to remedy the problem by replacing, repairing or refunding a consumer.
• (c)For any major problem, a consumer can choose to obtain a full refund or replacement by returning any goods and services, or can keep the product and request compensation for the reduction in value of the product.
• (d)Reasons for which LEJA will not provide a refund of membership fees include:
  • (i)Change of mind;
  • (ii)Failure to make use of subscription benefits, or to access available content or services, where this has been made accessible to the consumer;
  • (iii)Failure to make use of free Promotion entries where these have been made available to the consumer; or
  • (iv)Non-operation of Promotions in a given week for reasons beyond the control of LEJA, including lack of eligible sporting events,
  except where required by the ACL.

6. Analytics Platform - Disclaimer

• (a)All analytics, projections, confidence scores, matchup data, and related content provided through the LEJA platform are for informational and entertainment purposes only.
• (b)LEJA does not provide financial advice, betting advice, gambling tips, or recommendations of any kind. Nothing on the platform should be construed as a tip, recommendation, or endorsement of any wagering activity.
• (c)LEJA does not recommend, encourage, or facilitate any form of wagering, gambling, or sports betting activity.
• (d)All projections are generated through internally developed statistical models. They represent LEJA’s internal assessment of likely player output only. LEJA does not guarantee the accuracy of any projection.
• (e)Historical accuracy data, where displayed, reflects past projection performance only and is not a guarantee or indication of future accuracy.
• (f)Users access and use all analytics content entirely at their own discretion and risk. LEJA accepts no liability for any decision made, or action taken, based on information provided through the Platform.
• (g)LEJA is not affiliated with, endorsed by, or in any way connected to any sporting league, club, player, or official fantasy sports platform. Player names and statistics are used in a factual, informational context only and do not imply any association with or endorsement from the relevant player or league.
• (h)LEJA does not use any official league logos, team logos, or trademarked branding without appropriate authorisation where required by law.

7. Promotions

• (a)LEJA may from time to time conduct Promotions, which will entitle Eligible Persons to receive a prize or prizes in accordance with the terms of that Promotion.
• (b)By entering a Promotion, you warrant that you are an Eligible Person and that you agree to the Terms and Conditions as they relate to that Promotion.
• (c)The website and/or application will stipulate relevant information for each Promotion (the Promotion Details), including:
  • (i)The prize or prizes available and their value;
  • (ii)The commencement date of the Promotion;
  • (iii)The final end date of the Promotion;
  • (iv)The date by which entries must be finalised and submitted (Lock-In Time);
  • (v)Any other conditions of entry into the Promotion (including, for instance, the sport to which it relates, Promotions limited to entrants who reside in certain States or Territories etc);
  • (vi)The date that the Promotion will be drawn; and
  • (vii)Details of any permits for any State or Territory in which a permit is required for the conduct of that Promotion.
• (d)Unless specified otherwise, Promotions are open only to people who:
  • (i)are members of the LEJA Platform;
  • (ii)are residents of Australia;
  • (iii)are 18 years of age or older; and
  • (iv)have completed all requirements from time to time that are specified for the Promotion.
  (Eligible Person).
• (e)Employees, contractors, and immediate family members of LEJA and its associated entities are not eligible to enter.
• (f)By entering any Promotion, you warrant that you are an Eligible Person, and that you agree to these Terms and Conditions as they apply to Promotions.

8. How to Enter Promotions

• (a)In order for an Eligible Person to be entered into the Promotions (an Entrant) they must complete an entry in the form and with all information required by LEJA, during the relevant Promotion Period.
• (b)Eligible States/Territories for the purpose of each Promotion are indicated in the Promotion Details for that Promotion.
• (c)Entries for a Promotion from a person who is not an Eligible Person – including where a person becomes no longer an Eligible Person between the date of entry and the date of drawing of the Promotion - will be deemed invalid and are not eligible to win the Promotion or receive a prize. This includes where an Entrant moves residence, or where an Entrant’s membership is cancelled as of the date of the drawing of the Promotion.
• (d)Promotion entries are automatically allocated to subscribers of LEJA whose membership is active (ie not suspended) at the time of commencement of the weekly Promotion period.
• (e)No entry fee or separate purchase is required to obtain promotion entries or participate in the Promotions. Promotion entries cannot be purchased or obtained by exchange of any goods of value.
• (f)Subscribers who commence a new subscription, or renew a suspended/cancelled subscription, after the commencement of the Promotion period for a given week, will not be allocated entries for that week, and will instead be allocated entries for the following week’s Promotion.
• (g)The number of entries that a person accrues for a Promotion will be determined in accordance with the conditions of their membership tier.
• (h)Additional entries into Promotions may be accumulated through means determined by LEJA from time to time.
• (i)For the purpose of entry into Promotions, cancellation of a LEJA membership will result in withdrawal of any entries into Promotions that have not been drawn as at the effective date that the membership is cancelled.
• (j)Entries are personal, non-transferrable, nor redeemable for cash or any other consideration.
• (k)Entries do not accumulate or roll over, and are valid only for the Promotion week in respect of which they are allocated. Unused entries are forfeited at the conclusion of each weekly Promotion period.
• (l)During periods in which no Promotion is active — including due to the absence of qualifying sporting fixtures, off-season periods, or any other reason — subscribers will not receive any entries. This does not constitute a failure to deliver the subscribed service. No refund, credit, or compensation is payable in respect of any week in which no Promotion is available.
• (m)Upon receiving their free entries for a given week, subscribers must nominate the Promotion for which they wish to enter. Where multiple Promotions are running concurrently, subscribers may allocate their entries across different Promotions, or may make multiple entries into a single Promotion.
• (n)Entry selections cannot be changed after the Lock-in Time for each Promotion. Entries submitted after this time will not be accepted. No responsibility is accepted by LEJA for any late, incomplete, or lost entries.
• (o)By entering into the Promotion, you agree that your information may be published as a winner as required by law and these Terms and Conditions.
• (p)In the event of an actual or suspected breach of the Terms and Conditions by an Entrant, , any and all entries received from that Entrant are void and that Entrant will not be eligible for any prize.

9. Prizes

• (a)The Prize for each Promotion is set out in the Promotion Details, including the total available prize pool (minimum and maximum amounts), and any scaling and accumulation mechanisms.
• (b)A variable prize pool will be calculated using the metric (Prize Scaling Mechanism) set out in the Promotion Details, including a minimum and maximum prize value.
• (c)Entrants can view the accumulated total of the variable prize pool at any time during the Promotion Period by visiting [link], which will state the last date and time the prize pool was calculated. The final prize pool value will be officially published on this webpage immediately following the Lock-in Time.
• (d)If a winning entrant cancels their membership to LEJA prior to distribution of their prize, they forfeit their right to that prize.
• (e)Where a prize is unavailable for any reason, LEJA reserves the right to provide a substitute prize of equal or greater value.
• (f)Prize payments will be made by electronic funds transfer (EFT) to the winner’s nominated bank account following successful verification of the winner’s identity, age, state of residence, and overall eligibility.
• (g)Financial records of Prizes distributed are retained after finalisation of the Promotion in accordance with legislative requirements.

10. How to Win a Prize

• (a)In order to win a prize, Entrants must select a team of players from a pre-determined player pool for the relevant sport selected, nominating one (1) Captain and one (1) Vice-Captain, and finalise their selection prior to the nominated Lock-in Time.
• (b)Player scores are calculated using published fantasy scoring metrics for the relevant sport, and scores are based on real-world player performance in the corresponding round of gameplay. The score of the nominated Captain is multiplied by x2, and the score of the nominated Vice-Captain is multiplied by x1.5.
• (c)The Entrant whose selected team accumulates the highest aggregate fantasy score for the round — inclusive of Captain and Vice-Captain multipliers — wins the prize pool for that round.
• (d)In the event of a tied score, the prize pool will be split equally among all tied Entrants.
• (e)In the event that no valid entries are submitted for a given Promotion in respect of an available sport, no prize will be awarded for that week’s Promotion.
• (f)To the extent that any competition rules or contingencies are not covered by these Terms and Conditions, these may be set out in the Promotion Details or otherwise as determined by LEJA from time to time, including after completion of a Promotion in the event of ambiguity.
• (g)Any determinations as to outcome by LEJA are final and binding on all Entrants.

11. How to Claim a Prize

• (a)Prize winners will be notified using the User Information registered on their LEJA membership and informed of how to collect their prize.
• (b)The names of winners and any information required by law or by these Terms and Conditions will be published on the LEJA website and/or application.
• (c)LEJA reserves the right to request a winner provide proof to the satisfaction of LEJA that the winner is an Eligible Person and entitled to a prize.
• (d)Any winner of a prize in the Promotion is deemed to have forfeited the prize in the following circumstances:
  • (i)Where the winner has been determined to have breached any of these Terms and Conditions;
  • (ii)Where the winner has failed to provide satisfactory evidence that they are an Eligible Person within 7 days of a request by LEJA;
  • (iii)Where any correspondence to the winner has been returned to LEJA as ‘non-deliverable’; or
  • (iv)Where for any reason LEJA has not been able to facilitate the prize being delivered to a winner within 28 days after taking reasonable steps.
• (e)After 7 days have passed from a request by LEJA where the winner has failed to provide satisfactory evidence that they are an Eligible Person, or they are otherwise unable to be identified despite all reasonable steps being taken, LEJA reserves the right to substitute the prize winner with the next highest scoring team, who will be notified, and their name published, in accordance with the procedures outlined above.
• (f)The winner of a prize will not be charged an administrative or delivery fee by LEJA in order to receive their prize. LEJA is not responsible for any taxes, fees or other charges that may be imposed on the winner by any financial institution or authority for receipt of the prize.

12. Referral program

• (a)LEJA operates a referral program that allows existing subscribers to earn bonus Promotion entries by introducing new members to the Platform.
• (b)The referral is made by entering the email address of the existing subscriber in the relevant section when a new user is signing up. The email address must correspond with the email address that is registered for the existing subscriber in the LEJA database, and LEJA accepts no responsibility for any misspellings resulting in the existing subscriber’s account not being recognised.
• (c)Where a new user signs up and becomes an active paying subscriber following successful referral to the existing subscriber’s account, the referring subscriber will receive one (1) bonus Promotion entry, allocated to the following week’s competition round.
• (d)Bonus entries are awarded in addition to the subscriber’s standard weekly tier allocation. They do not replace or reduce standard entries.
• (e)A referral is only considered successful once the referred user has completed sign-up and made their first subscription payment. Referrals that result in a failed payment, chargeback, or cancellation within the first billing cycle will not qualify.
• (f)Bonus entries are subject to the same conditions as standard Promotion entries, including the no-rollover policy, and entry lock-in requirements.
• (g)LEJA reserves the right to amend, suspend or terminate the referral program at any time, and to disqualify referrals which LEJA has reason to believe were obtained through fraudulent, manipulative or abusive means.

13. Authorisation

• (a)LEJA is authorised to conduct the Promotions as trade promotion lotteries in accordance with the applicable laws in Victoria, and in each State or Territory to which any such Promotion applies.

14. Indemnity

• (a)You indemnify LEJA in respect of all loss, damage, costs, expenses (including legal fees on a full indemnity basis), fines, penalties, claims, demands and proceedings howsoever arising, whether at common law (including negligence) or under statute, in connection with any of the following:
  • (i)any breach of these Terms and Conditions by you;
  • (ii)your use of the Platform (including registration);
  • (iii)your entry into the Promotions;
  • (iv)any use of your LEJA account, including by third parties; and
  • (v)any claims that may be brought against LEJA or which LEJA must pay, sustain or incur as a direct or indirect result of the use by LEJA of your User Information.

15. Exclusions and Liability

• (a)Nothing in these Terms and Conditions limits, excludes, or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia.
• (b)Except for any liability that cannot by law be excluded, LEJA (including its officers, employees, and agents) is not responsible for and excludes all liability for any personal injury; or any loss or damage in the provision of any goods or services, or conduct of any promotion, whether direct, indirect, special, or consequential, arising in any way out of:
  • (i)any technical difficulties or equipment malfunction (whether or not under LEJA’s control);
  • (ii)any theft, unauthorised access or third party interference or intervention;
  • (iii)any addition, variation, substitution or removal of any goods or services provided by LEJA;
  • (iv)any limitation or restriction of access to any goods or services provided by LEJA;
  • (v)any entry or Promotion claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by LEJA) due to any reason beyond the reasonable control of LEJA;
  • (vi)any failure, delay or defect with or related to any network, service of transmission (including by not limited to post, telephone or internet);
  • (vii)any variation in prize or prize value to that stated in the Promotion;
  • (viii)any prizes damaged or lost in transit;
  • (ix)any tax liability incurred by a winner or entrant;
  • (x)use of any prize; or
  • (xi)any other circumstances outside the reasonable control of LEJA.
• (c)Where any event or occurrence outside of the control of LEJA prevents or hinders the ability to proceed with the Promotion or any part of it, LEJA may vary, cancel or re-schedule the Promotion or any part of it. Any such action must be conducted in accordance with the applicable law and regulatory requirements for the conduct of the Promotion.

16. Headings

• (a)The headings in these Conditions are for convenience only and do not affect interpretation.

17. Force majeure

• (a)LEJA will not be liable to you for any delay or failure to perform its obligations under these Terms as a result of a cause beyond its reasonable control, including acts of God.

18. Jurisdiction and law

• (a)These Terms are governed by and must be construed in accordance with the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of that State and the Commonwealth of Australia in respect of all matters arising out of or relating to these Terms, their performance and subject matter.

19. Severability

• (a)Each provision of these Terms is severable from the others and no severance of a provision will affect any other provision.
